1. Digital Photographs

In accordance with Article 15(ğ) of the Distance Contracts Regulation regarding exceptions to the right of withdrawal for digital content not supplied on a tangible medium, we generally do not offer refunds or exchanges for purchased digital photographs once the download link has been provided or the file has been accessed by the consumer.

By purchasing and accessing our digital photographs, you acknowledge and agree to this condition. Please carefully review the product description and preview images before completing your purchase. If you experience technical difficulties in downloading or accessing your digital file, please contact us immediately at [e-mail: inceperde@gmail.com], and we will provide prompt assistance to resolve the issue.

2. Printed Photographs

We take utmost care in the production and secure packaging of our high-quality printed photographs.

• Damaged Upon Delivery: If your printed photograph arrives in a damaged condition due to shipping (e.g., bent, torn, scratched), you must notify us within seven (7) days of receiving the product, as per Article 53 of the Consumer Protection Law. Please provide clear photographic evidence of the damage to both the packaging and the print. Upon verification of the damage, we will, at our discretion, either send you a replacement print at no additional cost or issue a refund for the purchase price, including any shipping fees you may have paid for the damaged item. We may request the return of the damaged print.
• Incorrect Product: If the printed photograph you receive does not match the order you placed, please notify us within seven (7) days of receipt. We will arrange for the correct product to be shipped to you at no additional cost and provide instructions for the return of the incorrect item (with return shipping costs covered by us).

Right of Withdrawal (Cayma Hakkı) for Printed Photographs:

As per Article 48 of the Consumer Protection Law concerning distance contracts, you, as a consumer, have the right to withdraw from the purchase contract for printed photographs within fourteen (14) days from the date of receiving the product, without providing any justification and without incurring any penalty (except for the return shipping costs, as per Article 48(5)).

To exercise your right of withdrawal, you must clearly notify us of your decision to withdraw within this 14-day period by sending an explicit statement via email to [e-mail: inceperde@gmail.com] or by postal mail to [address: Yesildere mh. Alacam cd. 49A/44 55200 Samsun/Türkiye]. You can use the standard withdrawal form provided in the Distance Sales Agreement (if applicable) or any other clear statement.

Upon exercising your right of withdrawal, you are obligated to return the printed photograph to us within ten (10) daysfrom the date of your withdrawal notification, in its original condition, unused, and with all original packaging and accessories. You are responsible for the direct costs of returning the product.

Once we receive the returned product and verify that it meets the conditions stated above, we will reimburse all payments received from you, including the initial shipping costs (if applicable), within fourteen (14) days from the date we receive the withdrawal notification, using the same payment method you used for the initial transaction, unless you have explicitly agreed otherwise.

Exceptions to the Right of Withdrawal:

Please note that the right of withdrawal does not apply to digital content that is not supplied on a tangible medium (as mentioned in Section 1) once the performance has begun with the consumer’s prior express consent and acknowledgment of losing the right of withdrawal.

3. Photography Services

Refund and cancellation policies for photography services are governed by the specific terms and conditions outlined in the individual service agreement or booking confirmation you enter into with us. Please refer to that document for details.

4. How to Request a Return, Replacement, or Exercise Your Right of Withdrawal for Printed Photographs

1. Notification: Contact us via email at [Your Email Address] within the applicable timeframe (7 days for damage/incorrect item, 14 days for right of withdrawal).
2. Details: In your email, please include your order number, a clear description of the issue (damage, incorrect item, or your decision to withdraw), and attach clear photographic evidence if the issue is damage or an incorrect item. For withdrawal, a clear statement of your decision is sufficient.
3. Instructions: We will review your request and provide you with further instructions on how to proceed, including return shipping arrangements if necessary.

5. Shipping Costs for Returns and Replacements

• For returns of damaged or incorrect items, we will cover the return shipping costs.
• For exercising your right of withdrawal, you are responsible for the direct costs of returning the product.
• We will cover the shipping costs for sending a replacement for damaged or incorrect items.

6. Governing Law and Dispute Resolution

This Refund and Return Policy shall be governed by and construed in accordance with the laws of the Republic of Türkiye. In the event of any disputes arising from this policy, the Consumer Arbitration Committees or the Consumer Courts in your place of residence or our business location shall have jurisdiction, in accordance with the relevant provisions of the Consumer Protection Law.
